SERVICE

By accessing or using Bring The Lowboy ("the Platform," "we," "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform. You must be at least 18 years old to register or participate in any auction.

Bring The Lowboy operates an online marketplace for the auction of used heavy equipment. We facilitate transactions between sellers and buyers but are not a party to any transaction. All listings are subject to editorial review before going live.

• All bids are legally binding commitments to purchase at that price.
• Bids cannot be retracted once placed.
• The highest bid at auction close, if meeting any reserve price, constitutes a binding sale.
• Auction end times may extend if a bid is placed in the final 10 minutes (anti-shill extension).
• We reserve the right to cancel bids or suspend accounts engaging in bid manipulation or shill bidding.
• Proxy bidding is available — enter your maximum and the system bids incrementally on your behalf.

• Winning bidders must complete payment within 3 business days of auction close.
• A 5% buyer's premium is added to the final bid price.
• Buyers are responsible for all transportation, loading, and removal of equipment.
• Equipment is sold as-is, where-is. Inspect before bidding.
• Failure to complete payment may result in account suspension and forfeiture of any deposit.

Sellers must accurately represent all equipment. False representations, undisclosed defects, or fraudulent listings are grounds for immediate removal and potential legal action. See our Seller Agreement for full details.

• Listing on the Platform is free.
• A 5% success fee is deducted from sale proceeds before payout to the seller.
• Buyers pay a 5% buyer's premium on top of the hammer price.
• No fees are charged if equipment does not sell.

All payments are processed through Stripe. Buyer funds are held in escrow until both parties confirm the transaction. Seller payouts are issued within 3 business days of confirmed receipt by the buyer. We are not responsible for delays caused by banking institutions.

• Stolen equipment or equipment with encumbrances not disclosed to the buyer
• Equipment with falsified hour meter readings or documentation
• Shill bidding, bid manipulation, or any form of auction fraud
• Creating multiple accounts to circumvent bans or fees
• Harassing, threatening, or defaming other users

Sellers may allow third-party pre-auction inspections at their discretion. The Platform does not arrange, conduct, or guarantee inspections. Buyers assume full responsibility for their due diligence.

In the event of a dispute between buyer and seller, contact us at support@bringthelowboy.com. We will make reasonable efforts to mediate but are not liable for the outcome of any transaction dispute. All disputes are subject to binding arbitration under the rules of the American Arbitration Association.

The Platform is provided "as is." We make no warranties, express or implied, regarding uptime, accuracy of listings, or fitness for purpose. To the maximum extent permitted by law, our total liability to you shall not exceed the fees paid by you to us in the 12 months preceding the claim.

We reserve the right to suspend or terminate any account at any time for violations of these Terms or for any other reason at our sole discretion. Upon termination, all pending bids may be cancelled.

We may update these Terms at any time. Continued use of the Platform after changes constitutes acceptance. Material changes will be communicated via email to registered users.

These Terms are governed by the laws of the State of Colorado, without regard to conflict of law principles.
